Herschel Supply Company Ltd.’s “Product Review Contest” (the “Contest”) entry period starts on 18 mars 2025 at 12:01 a.m. Pacific Standard Time (“PST”) and ends on 1 avril 2025 at 11:59 p.m. PST (the “Entry Period”).

ELIGIBILITY: The Contest is open to residents of Canada (except Quebec) and the 50 United States of America, and District of Columbia who have reached the age of majority in their state, province or territory of residence as of the start of the Entry Period.  Entrants must have (i) utilized one or more Herschel products within the last year, and (ii) opted into receiving email communications from Herschel Supply Company Ltd. (the “Sponsor”) in order to enter.  Employees, directors, officers, agents and other representatives of the Sponsor or its affiliates, or any of their family members, are not eligible to enter or win. HOW TO ENTER: During the Entry Period, entrants must (i) click to follow the instructions provided in a product review invitation emailed to eligible entrants by the Sponsor prior to the Entry Period, and (ii) review at least one product on www.herschel.ca or www.herschel.com as applicable, all in accordance with the Sponsor’s website Terms of Use and the Sponsor’s product review terms and conditions (an “Entry”).  Sharing a photo along with your Entry will count as a bonus Entry.  All product reviews submitted between 18 mars 2025 to 1 avril 2025 will automatically be entered into the Contest as an Entry.

Toute Inscription que le Promoteur juge, à sa seule discrétion, non conforme aux exigences d’éligibilité ou d’inscription ou qui ne respecte par ailleurs pas les conditions générales énoncées dans le présent Règlement officiel sera nulle et non avenue.

Les Inscriptions générées par script, macro ou autres moyens automatisés sont nulles et non avenues. Le Promoteur n’est pas responsable des inscriptions reçues après le délai de participation, perdues, mal acheminées, retardées, incomplètes ou incompatibles. Le Promoteur se réserve le droit, à sa seule discrétion, de disqualifier tout participant qu’il estime tenter de falsifier ou de saboter le processus d’inscription ou le fonctionnement légitime du Concours ou d’agir en violation du présent Règlement officiel.

MAIL-IN METHOD OF ENTRY: Alternatively, entrants may submit a mail-in entry by handwriting their first and last name, street address, phone number and email address on a piece of paper, inserting the paper in a #10 envelope and mailing the entry to: Herschel Supply Company Ltd. 108-611 Alexander St, BC., Vancouver, BC V6A 1E1, Attn: E-Commerce Department (“Mail-in Entry”).

LICENSE/USE OF ENTRIES: en envoyant une Inscription, chaque participant garantit et accepte : (a) that he/she has obtained the necessary consent of any other person or property featured in his/her Entry; (b) that the Entry does not infringe on the intellectual property, privacy, publicity or other rights of any third party; (c) to permit the Sponsor to use his/her name, Entry, o handle, and likeness in announcements and promotions regarding the Contest; (d) to release and hold harmless the Sponsor, its affiliates, advertising and promotion agencies, and each of its and their respective agents, employees, directors, officers, successors and assigns (the “Released Parties”) from and against any and all claims including but not limited to claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action. 

ENTRY REQUIREMENTS: Les Inscriptions doivent répondre aux exigences suivantes :

● Ne doivent pas porter atteinte aux droits d’auteur, marques commerciales, droits de confidentialité, de caractère public ou autres droits de propriété intellectuelle ou autres droits d’une personne physique ou morale.

● Ne doivent pas contenir, tel que déterminé par le Promoteur à sa seule discrétion, tout contenu qui : est sexuellement explicite ; violent ou désobligeant à l’égard de toute origine ethnique, race, sexe, religion, profession ou âge ; profane, vulgaire, offensant ; contient de la nudité ; promeut l’alcool, des stupéfiants, le tabac, les armes à feu/armes ; promeut toute activité qui peut être ou sembler être risquée, dangereuse ou illégale ; promeut tout programme ou message politique particulier ; diffame, donne une fausse image ou contient des remarques désobligeantes ou diffamatoires à propos d’autres personnes ou sociétés ; contient des informations personnelles, contient des documents protégés par des droits d’auteur appartenant à d’autres personnes ; enfreint toute loi ou réglementation ; est trompeur ou frauduleux ; contient des messages commerciaux, des comparaisons ou sollicitations de produits ou services et/ou tout autre contenu qui est ou pourrait être considéré comme inapproprié, inadapté ou offensant, tous tels que déterminés par le Promoteur à sa seule discrétion.

PRIZE:  There are two (2) prizes available to be won, each consisting of one (1) $500 (CAD or USD) travel voucher for available flights and accommodations through WorldGo travel management company. All travel must be booked through WorldGo following instructions provided by Sponsor to the winner. The Prize is not transferable and cannot be substituted or converted to cash except that the Sponsor reserves the right in its sole and absolute discretion to substitute all or part of the Prize for a prize or prizes of equivalent value, for any reason. All federal, state, provincial and local taxes associated with acceptance or use of the Prize are the sole responsibility of the winner.

WINNER SELECTION: Winners will be randomly selected.  The potential winners will be determined on 8 avril 2025, at approximately 1:00 p.m. PST (the “Selection Date”) at the Sponsor’s office or other designated area: 108-611 Alexander St., Vancouver, BC.

SKILL TESTING QUESTION: In the event the winner is a resident or citizen of Canada (a “Canadian Winner”) then, the Canadian Winner must correctly answer, unaided and within a set timeframe, a mathematical skill testing question as a condition of receiving the Prize.

WINNER NOTIFICATION: The Sponsor or its designated representatives will contact the potential winners by email. The potential winners will then have 72 hours to claim the Prize by providing a name, email address and mailing address to Sponsor. If the potential winners do not respond within 72 hours or if the winners are otherwise not in compliance with these Official Rules, then the potential winners may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize). If the potential winner does not, within 72 hours from being notified, contact Sponsor and complete, sign and return the declaration of compliance and release form within five (5) business days of receiving it, or there is a return of any notification as undeliverable, or is otherwise not in compliance with these Official Rules, then the potential winner may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize), in which case an alternate winner will be chosen based on the judging criteria (in which case the foregoing provisions of this section shall apply to such potential winner).

GENERAL CONDITIONS: en prenant part au concours, chaque participant accepte de respecter le présent Règlement officiel et les décisions du Promoteur, qui seront définitives et auront force obligatoire à tous les égards relatifs au présent Concours. Le Concours sera organisé conformément au Règlement officiel, sous réserve de modification par le Promoteur. Chaque participant doit respecter le Règlement officiel et sera considéré comme ayant reçu et compris le Règlement officiel en participant au Concours. Les conditions du Concours, telles qu’énoncées dans le Règlement officiel, ne sont pas sujettes à modification ou contre-offre, sauf tel qu’énoncé dans les présentes. Si l’une des dispositions quelles qu’elles soient du Règlement officiel est jugée invalide ou inapplicable, toutes les dispositions restantes des présentes resteront en vigueur et de plein effet. La non application par le Promoteur de l’une des dispositions quelles qu’elles soient du présent Règlement officiel ne constituera pas une renonciation à cette disposition.

Sans limitation, la responsabilité d’Instagram et des Parties libérées ne pourra être engagée : for any technical malfunction or other problems relating to the network or lines, computer on-line systems, servers, access providers, computer equipment or software; for the failure of any Entry to be received by the Sponsor for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website; for printing or other errors appearing in these Official Rules or other Contest materials, misprints or errors in other Contest-related information, technical or mechanical malfunctions, or other problems or errors, whether caused by equipment, programming used in this Contest, processing errors, human errors or otherwise; or any combination of the above. En outre, les Parties libérées ne pourront être tenues responsables des préjudices ou dommages à l’ordinateur ou aux données qu’il contient d’un participant ou d’une autre personne, liés à ou résultant de la participation au Concours ou du téléchargement de tout matériel du Concours.

Le Promoteur se réserve le droit de retirer, suspendre ou modifier le présent Concours ou le présent Règlement officiel pour quelque raison que ce soit, y compris dans le cas où une erreur, un problème technique, un virus informatique, des bogues, une altération, une intervention non autorisée, une fraude, une défaillance technique ou toute autre cause indépendante de la volonté du Promoteur interférerait avec la bonne conduite du Concours, comme prévu par le présent Règlement officiel. En cas de résiliation, le Promoteur attribuera le Prix dans la mesure jugée juste et équitable par le Promoteur.

En cas de litige, les Participations seront considérées comme ayant été soumises par le titulaire autorisé du compte Instagram soumis au moment de la Participation. Le « titulaire d’un compte autorisé » est défini comme la personne qui possède l’adresse e-mail attribuée par un fournisseur d’accès Internet, un fournisseur de services en ligne ou une autre organisation (par ex. entreprise, établissement d’enseignement, etc.) chargé d’attribuer des adresses e-mail pour le domaine associé au compte Instagram soumis.

Tous les problèmes et questions concernant la construction, la validité, l’interprétation et l’applicabilité du présent Règlement officiel, ou les droits et obligations des participants et du Promoteur en relation avec le Concours, seront régis par les lois de la province canadienne de Colombie-Britannique, et les lois du Canada telles qu’elles s’appliquent en Colombie-Britannique, et interprétés conformément à celles-ci. Les tribunaux de Colombie-Britannique auront la compétence exclusive sur tous les litiges découlant du présent Règlement officiel, du Concours ou du Prix ou en relation à ceux-ci.  

RELEASE AND INDEMNIFICATION: EN PARTICIPANT AU PRÉSENT CONCOURS, LES PARTICIPANTS ACCEPTENT DE LIBÉRER, DÉCHARGER ET DÉGAGER LES PARTIES LIBÉRÉES DE TOUTE RESPONSABILITÉ CONCERNANT TOUTE ACTION, MOTIF, RÉCLAMATION, COÛT ET PAIEMENT EN CAS DE DOMMAGES, PERTE, BLESSURE OU DÉCÈS, QUELLE QU’EN SOIT LA CAUSE, EN TOUT OU EN PARTIE, DIRECTEMENT OU INDIRECTEMENT, RÉSULTANT DE LA PARTICIPATION AU CONCOURS OU À TOUTE ACTIVITÉ LIÉE AU CONCOURS OU RÉSULTANT DE L’ACCEPTATION, DE L’UTILISATION OU DE LA MAUVAISE UTILISATION DU PRIX OU DE LA PARTICIPATION AU PRIX.

PRIVACY: Information submitted in connection with the Contest will be treated in accordance with these Official Rules and Sponsor’s Privacy Policy (as amended from time to time), currently available at https://www.herschel.com/privacy-policy/. WINNER LIST: To request the winner list (available for 180 days from the date of verification of the winner to the extent such list can be disclosed subject to applicable privacy legislation), send a self-addressed, stamped (except U.S. residents) envelope to: Herschel Supply Company Ltd., Attn: Contest Winner, 108-611 Alexander St., Vancouver, BC V6A 1E1.
